The next meeting of the Zoning Board of Appeals will take place on Thursday, September 17, 2026 at 7pm. Two (2) Public Hearings will be held prior to regular business.
The 1st Public Hearing will be held regarding an an application for an area variance by ArtGarden, LLC, Application #2026-077: Tax Map #66.5-2.13; 5 Fairview Ave, Chatham, NY. The applicant seeks an area variance for a 6’ fence in the front side yard. A 4’ fence is the maximum height allowed by the Zoning Code in such location.
The 2nd Public Hearing will be held regarding an application for an area variance by Jack Moore, Application #2026-080: Tax Map #66.5-2-13; 34-36 Church St, Chatham, NY. The applicant seeks an area variance to construct a 6’ high fence in place of the damaged garage located within the front yard setback along with less than 35% of open space to match existing non-compliant fence. Expansion of non-compliant fence exceeds 25%. A 4’ fence is the maximum height allowed by the Zoning Code in such location. In addition, no front yard fence shall result in the creation of a blank solid wall along the street. A fence with less than 35% of its surface being open shall be considered a solid wall.
